Please read these Terms of Service ("Terms") carefully before using the Prompt GPT website located at https://promptgpt.ca ("Service"), operated by the founders of Prompt GPT ("we," "us," or "our").

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Service.

Prompt GPT is an AI-powered prompt engineering platform that helps users generate detailed, production-ready prompts for use with third-party AI systems such as ChatGPT, Claude, Gemini, and similar tools. Our platform uses the OpenAI API with a Retrieval-Augmented Generation (RAG) architecture to produce high-quality prompts based on user inputs.

The Service is provided free of charge, supported by advertising revenue through Google AdSense.

4. Intellectual Property

4.1 Our Content

The Prompt GPT platform, including its design, code, branding, interface, and underlying systems, is the intellectual property of the Prompt GPT founders and is protected by applicable copyright, trademark, and other intellectual property laws.

4.2 User-Generated Outputs

Prompts generated by the Service in response to your inputs are provided for your personal and commercial use. You may use, copy, modify, and distribute these generated prompts without restriction. However, we do not warrant that generated outputs are original, free from third-party rights, or suitable for any particular purpose.

4.3 Your Inputs

You retain ownership of the messages and queries you submit to the Service. By submitting content, you grant us a limited, non-exclusive license to process your input solely for the purpose of providing the Service (i.e., generating a prompt response via the OpenAI API).

6. Disclaimers and Limitation of Liability

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied. We do not warrant that:

To the maximum extent permitted by applicable law, in no event shall Prompt GPT, its founders, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, or goodwill — arising out of or in connection with your use of the Service, even if we have been advised of the possibility of such damages.

Our total liability for any claim arising out of these Terms or your use of the Service shall not exceed CAD $100.

7. Advertising

Prompt GPT displays advertisements through Google AdSense. These ads help us keep the Service free. By using the Service, you acknowledge that advertisements may be displayed and that Google may collect data as described in our Privacy Policy.

We do not endorse any advertised products or services and are not responsible for the accuracy or content of any advertisements.

8. Termination

We reserve the right to terminate or suspend your access to the Service at any time, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service ceases immediately.

9. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law provisions.

Any disputes arising from these Terms or your use of the Service shall be resolved through good-faith negotiation. If a resolution cannot be reached, disputes shall be submitted to the courts of competent jurisdiction in Ontario, Canada.

10. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the "Last updated" date at the top of this page. Your continued use of the Service after any changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.

11. Severability

If any provision of these Terms is found to be invalid or unenforceable under applicable law, the remaining provisions will continue in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it enforceable.
